Any individual, or group of people, using our website must agree to the following terms and conditions agreement. Please read the agreement carefully and let us know if you have any questions or concerns. If you do not agree to all the Terms and Conditions or the Privacy Policy, do not use our website or place an order.

This website is owned and operated by Balboa Mattress & More. The terms “we”, “us”, and “our” refer to Balboa Mattress & More. The use of our website is subject to the following terms and conditions of use, as amended from time to time (the “Terms”). The Terms are to be read together by you with any terms, conditions or disclaimers provided in the pages of our website. Please review the Terms carefully. The Terms apply to all users of our website, including without limitation, users who are browsing, customers, merchants, vendors and/or contributors of content. If you access and use this website, you accept, understand, and agree to be bound by and comply with the following Terms and our Privacy Policy.
The term “charged” and “collected” is used interchangeably and means receiving currency from the buyer/customer. The term “product” and “item” is used interchangeably and means an actual physical thing that can be purchased by a customer.

Acceptable Use
By using our website and making a purchase constitutes an acceptance of everything in this agreement.
You must not use this website in any way that causes, or may cause, damage to the website or impairment of the availability or accessibility of the website; or in any way which is unlawful, illegal, fraudulent or harmful, or in connection with any unlawful, illegal, fraudulent or harmful purpose or activity.
You must not use this website to copy, store, host, transmit, send, use, publish or distribute any material which consists of (or is linked to) any spyware, computer virus, Trojan horse, worm, keystroke logger, rootkit or other malicious computer software.
You must not conduct any systematic or automated data collection activities (including without limitation scraping, data mining, data extraction and data harvesting) on or in relation to this website.
You must not use this website to transmit or impersonate us by unsolicited commercial communications.
You must not use this website for any purposes related to marketing.
You are free to browse through our products and the information on this website.

Returns
All sales are considered FINAL. No cancellations, returns, or exchanges.
If you have questions regarding an item, don’t hesitate to contact us before doing a purchase.

In the very rare event that your furniture is defective, at our discretion and based on the defective component, we will replace the component or the whole furniture. We don't deliver damaged goods. We would contact you if we must reorder any item that is delivered damaged to us. If you are missing any advertised pieces, hardware, or have issues with your new furniture, please inform us no more than 48hrs after delivery or pick up. Any sign of physical damage or alterations made to the item while in your possession will void the warranty and/or replacement. All warranty is with the manufacturer directly.

We recommend a thorough inspection of your furniture before signing off either during delivery or when picking it up.

 

Delivery Methods and Timing
We have two methods for how you can obtain your ordered items: Curbside Delivery or Store Pick Up.

[Curbside Delivery]
Currently, we are serving communities up to 50 miles radius from San Marcos, CA. Orders of $699 or more are eligible to get free curbside delivery. Any order of less than $699 has a $39 flat-rate fee applied, regardless of the item(s) count. Curbside delivery means that we will deliver to the curb or outside of the delivery address.

Our standard delivery time frame is generally between 4 – 10 business days, depending on item availability and the time of purchase. Holidays are excluded to count as a regular business day. Once we have all your ordered items, we will call to schedule the delivery as soon as possible. We may give you an hour estimate time frame for delivery, but there is no guarantee. Several factors that are out of our control contribute to delivery delays, but rest assured that we will deliver the day it is scheduled. We thank you for your patience in advance.

We only deliver through our proprietary vehicle without the use of a freight carrier or any 3rd party company. Therefore, we do not offer tracking number for deliveries.
Items that are back-ordered with our distributor might delay delivery until we receive the items. We will notify you if an item you purchased is either on back-order or discontinued.

During the day of scheduled delivery, please make sure at least one adult over 18 years of age is present. However, note that this person, either you or appointed by you, is responsible for counting, inspecting the delivered item(s) quality, signing off the delivery, and moving the items into your home. Usually more than one person is required to move furniture, so please keep that in mind.

If for any reason our delivery team ever needs to enter your home, please be aware that they cannot remove their shoes for safety reasons. Regardless if the carpet is a special color/fabric, there are any personal beliefs, cultural traditions, or just preference.
Our curbside delivery service does NOT include the following:

  • White-glove furniture placement inside the home
  • Moving or removal of old furniture or any other household items
  • Assemble or set up any furniture (unless scheduled separately)
  • Set up or program any electronic equipment
  • Take mattresses or furniture up stories via stairs or an elevator
  • Remove the trash made by the new furniture

[Store Pick Up]
You may also choose to pick up the items yourself. Select “Pick Up In Store” during checkout and as soon as we receive the items we will contact you for pick up.
You will be responsible for loading your items on your vehicle. We recommend that you inspect your items at the store before loading them on your vehicle. If you request our assistance for loading, know that Balboa Mattress & More is not responsible for any damages made to your vehicle while loading or injury you might get while loading. We are also not responsible for any subsequent damage or injury during the transportation of your items, when you are unloading the items, or when you are moving them into your residence. A signature is always required when handing over items, so a signature will be required from you. Make sure you bring a vehicle that can safely transport all your ordered items. Sometimes a truck or large SUV is not enough for large orders. We do not recommend tying down anything on vehicle roofs. Make sure you tie down the items properly and safely. We are not responsible for any item damage or loss after you have left the store.

If you are sending someone to pick up the items for you, you must call us in advance with the person’s first and last name. For your order’s security, we will not hand over any items until we verify the person’s driver license. Please note that “you” becomes “he,” “she,” or “them” in the previous paragraph. You are appointing this person, or group of people, to be you during pick up, therefore the individual(s) will be just as responsible and they will represent you. A signature will also be required to sign off for the items.
A delivery or pick up cannot be scheduled until payment for your order has been fully processed. If you have any questions regarding your delivery, please don’t hesitate to contact us.

Mattress Recycling Fee
All new mattresses, box spring, and foundations are required to have a recycling fee collected for every piece regardless of size. As a retailer, we are obligated by California law to charge $10.50 per individual piece regardless of the size or material. Our eCommerce Software does not have the capability to add this item automatically whenever you add a mattress and/or foundation to the cart. Therefore, you must add the CA Mattress Recycling Fee item to your cart and set the quantity to the total number of physical pieces you are going to receive. All California retailers are obligated to collect this fee, whether it is done automatically or not. The invoice will ultimately show somewhere the recycling fee being charged.

Each mattress, box spring, or foundation is considered (1) individual piece. When a mattress is added to the cart WITH a foundation, then the quantity counts as (2) pieces for that set. Therefore, (2) recycling fees need to be added to the cart. Either King size mattress that is purchased WITH the foundation, the quantity counts as (3) for that set, since two foundations are used for the top mattress. Therefore, (3) recycling fees need to be added to the cart. Any mattress added WITHOUT the foundation(s), then the quantity counts as (1) piece. When buying multiple sets of mattresses and/or foundations, just add the number of all the pieces and that quantity becomes the number of recycling fee added to the cart.
The CA Mattress Recycling Fee item can be found if you click on the “Mattresses” category link or in any mattress item page. If you already have one recycling fee added to the cart and need to add more, you can update the quantity in the cart.
The fee applies only to new items being sold in the State of California. Since our items are brand new, the law always applies.

If you are not buying any mattress(es) and/or foundation(s), then the recycling fee is not required to be added to the cart.
Be aware that any order with the incorrect quantity of recycling fee will be placed on hold. We will contact you to purchase the missing recycling fees and the order will return to normal status once payment has been processed.

Item Descriptions
We get item information from the manufacturer and/or our vendors. We try to cross-reference the information with other places to verify and provide you consistent accurate description. However, the information cannot be guaranteed by us, since we are not a manufacturer or owner of any particular item. Note that buying an item that has the same color as another of your current furniture does not mean the colors will match. For example, the color Espresso might be different than another manufacturer that calls their color Espresso. Use our item descriptions as a reference only. We provide as many images as we can to better assist you in appreciating the colors. Contact us if you have any questions about a particular item.

Mattress manufacturers are known to change their fabric colors without notice. The mattress will do the same function, but the color might be different. Same goes for patterns, they are known to also alternate patterns at random.
We have no control of the mattress or furniture aesthetics.

Most furniture requires assembly. You will need basic common tools to assemble the furniture. We offer to assemble furniture for an additional fee, but it must be scheduled independently.

If you are using our dimensions for fitting, please add three (3) inches just to be safe. Our furniture dimensions is usually the same or very close to the posted value.

Order Cancellation and Cooling Off
An order cannot be cancelled once it has been submitted. You assume that you are purchasing items in good faith when you submit an order.
There is no “cooling-off” period or time frame to test out mattresses and/or furniture. We sell furniture that leaves our customers happy with their purchase.

Fees
[Delivery]
There is a flat-rate curbside delivery fee of $39 when any order is less than $699.
There is no delivery fee if you choose to pick up your items or if your order is $699 or more.

[Assembly]
If you would like your furniture assembled by us, an appointment is needed separate from delivery and there is a fee for the labor. The assembly fee amount will vary depending on the number of items and the time it will take to complete the job. Please contact us for inquiries regarding assembly pricing and/or scheduling an assembly.

Taxes
There is an applicable sales tax collection on all our transactions. We charge the current San Marcos, CA tax rate of 7.75%. All items in our store will get taxed the same rate, unless it is specified otherwise in the product description.
An item excluded from sales tax is the California Mattress Recycling Fee. The item(s) will be added to the order’s subtotal amount, but there is no sales tax collected for each recycling fee(s).
Currently, we do not sell or deliver items outside of California, so no other tax or state laws apply.

The tax rate will change accordingly to meet the California State Board of Equalization regulations with or without notice. You can see the tax rate you are being charged in the checkout page before you complete your order and on your invoice after you submit your order.

Pricing
We strive to provide prices that meet a variety of budgets. We work hard in updating prices as soon as we can to keep items up-to-date. Our prices are quoted in United States(US) Dollar currency.
No tricks, lies, hidden fees, or deceptions. Actual price does not include any accessories or decorations that might be included in item images. Images are for item visual representation only. The item description might give more information regarding if something is included. Larger items not included will be stated below the item price.

Pricing for any item related to a mattress is set as a Queen size by default. You must change the size to see other size pricing. This includes, but not limited to: bed frames, mattresses, headboards, and bedroom sets.


Sale prices are generally temporary and have an expiration date, which will be posted on the given item.
We reserve the right to change an item’s price at any time with or without notice. We also reserve the right to cancel an order if a purchased item’s price is incorrect. We would contact you of any pricing issues before acting.

[Price Match]
We currently only price match mattresses. The item requirements are: exact same brand, model, type, specification, and size. Color and/or pattern can vary, but the rest must be identical. No similar item matching. The said competition must be a real and reputable company.

Special Financing
We do offer financing through a financing bank, Synchrony Financial (aka Synchrony Bank), to assist you in completing your purchase. We are not a bank and we do not finance any of our transactions. Therefore, any promotions or terms are set and applied by the financing bank mentioned. We will provide you available promotions based on the financing bank and the offer will have a start date and an expiration date. By applying for financing, you are establishing a relationship with the financing bank so you can then take advantage of available promotions.

A credit application is required with the financing bank that will require from you but not limited to the following: first name, last name, social security number (SSN) or individual taxpayer identification number (ITIN), primary phone number, mailing address, email address, date of birth, monthly net income, and housing status. Please read their Terms and Conditions as well as their Privacy Policy, since they might be different than ours in terms of handling your personal information.

The length of the financing is set by the financing bank mentioned and not Balboa Mattress & More. We do not have a say or access to who gets approved. All credit applications are subject to approval on several factors, including but not limited to: credit score, monthly income, length of time at employment, late payments, a high debt-to-income ratio, or a high number of recently opened accounts. We cannot guarantee that you will be approved for financing. The mentioned bank will determine, at their discretion, if you are approved for credit or not, based on your personal information and credit history. If you are not approved, the financing bank should send you a letter explaining their reasons for denied credit.

If approved, the length of financing can vary between 6 and 48 months, depending on the available promotion at the time of purchase. The Annual Percentage Rate(APR) will also vary and will be stated in the promotion advertisement. A minimum purchase is required to apply a current promotion and the amount will be stated in the promotion advertisement. A single order must be purchased together to apply a promotion, since the financing bank does not accept split payments. Minimum monthly payments are required.
Print out the confirmation page that has the temporary card information and bring it in to the store. We can process your purchase and apply the available promotion.

After the promotion ends, the APR will return to the normal Purchase APR of the financing bank, which you can find in their Terms and Conditions credit agreement. The bank's average normal Purchase APR ranges between 27.99% to 29.99% and varies per person. Keep in mind that if the balance is not paid in full by the end of the promotional month, you might be liable for the full interest accumulated of the purchase since the date of purchase. The terms are always set by the financing bank and not us. You may review your terms, provided by the financing bank, if you have any questions.

We highly recommend you pay more than the minimum monthly payment to pay the balance off before the promotion’s expiration date. Otherwise, you will most likely have to pay all the deferred interest that might have accumulated over the time of the financing.

If you already have credit with the mentioned bank, you can still take advantage of our promotions. However, the credit card must belong to a Home Furniture or Home Design category, as per the bank's conditions. We reserve the right to remove a promotion if the promotion ends with the financing bank prematurely at any time with or without notice.

Payment Terms
We gladly accept online payment from Visa, MasterCard, Discover, and American Express cards that were issued in the United States. The card type may be any of the following: Credit, Debit, Gift, Prepaid, and Rewards. Our payment processor will run all transactions as credit, so it might take up to a few days before you see the charge posted on your account. Consciously, deduct the purchase amount from your card’s available balance so you can prevent any overdrafts until the charge appears on your account. Every creditor and bank has different processes and policies, so the timing will vary between 1 - 7 business days for a purchase to post. You will see a Withdrawal entry that starts with “Sq *Balboa Mattress” or “SQ* Balboa Mattress”.
Some Gift and Reward cards might need to be registered for our payment processor to accept them. An unregistered Gift or Rewards card usually has no billing address on file, which might be a factor for a declined purchase. This requirement is set by the card grantor and not Balboa Mattress & More. However, not all Gift and Reward cards have this requirement.

Unfortunately, we cannot offer the option to split a payment. The order must be paid in full during checkout using a single card. There is a limit of $15,000 per single submitted order. The given amount should include the subtotal, taxes, recycling fee, or any other fees. Any order with a greater amount will not go through our payment processor.

For your security, be aware that sometimes creditors impose a daily transaction limit on their accounts. If an order does not go through, call the number on the back of your card. In most cases, you just authorize the purchase and then try again. We have no authority or jurisdiction whatsoever to control your card’s daily transaction and approve an order. The process is all done autonomously between your card grantor and our payment processor in a secure way.
Other than the four major credit card brands, we also do offer special financing through a financing bank. For more information, look for the Financing section in our Terms and Conditions. We will be happy to get you a step closer to getting your home furnished.
Checks and cash are accepted in-store only.

Account Registration
You may create a user account with us to ease your shopping experience. Know that your registration is personal to you and nobody will have access other than yourself. When creating an account, the following information must be accurate and truthful: email, first name, last name, phone, address, city, country, state, and zip code. You will be asked to choose a preferred password. Don’t share or allow others to use your personal account, since each user account is intended for a single user only. A user is an individual person and not more than one person or group of people. You will be responsible for updating your personal information and keeping your login information private.

If you ever forget your password, you can reset your password via the link “Reset my password” when logging in. An email will be sent to the most current email associated with the account with a link to reset the password.
Product reviews may be submitted to help others make the right decision. Please refrain always from using any type of explicit language or provocative expressions. Any type of review that deems to be offensive, insulting, demeaning, with a bullying tone, or non-item related, will not be approved and your account is subject to being deleted. Delivery-related reviews DO NOT constitute an actual review of an item. All reviews need to be approved before being allowed to post. Images or any type of uploading is not allowed.

Data Protection
We use Secure Socket Layer(SSL) encryption to protect your information. SSL is an industry standard that encrypts your submitted information during transport. Our sensitive-based pages will only work in a secure webpage to protect you from any loss, misuse, or alteration of information during transit. You can verify this by looking for the green lock along with an https in the web browser’s URL bar. Some examples are, but not limited to, the checkout page and log in page. Remember to guard your login information to prevent any unauthorized access to your personal information.

Please note that there is no possible physical verification of every person that submits a purchase through our webpage. Just like anything in the web, there is never a full guarantee to prevent credit theft from occurring. We do our best to combat fraudulent transactions and we will do everything possible to resolve any arising issues. We will not support or enable any type of abuse or breach of your information. If you think your account has been compromised, don’t hesitate to contact us immediately. We will prosecute any unauthorized or fraudulent transaction to the fullest extent permitted by California law.

Be aware that we will never email you requesting for any verification of credit card, bank, log in, or any other type of personal information. The only exception would be if you submit a claim for a fraudulent transaction. However, we would contact you by phone for that information and not email. Please DO NOT respond to those emails, as they will not be from us. Also, please DO NOT click on any links included in the email. Help us by protecting your information further from these common phishing attacks.
When in doubt, give us a call and we can verify if we are trying to contact you. Full details on our privacy information and how we handle your information can be found in our Privacy Policy webpage.

Termination of Account
If at any time your account is used to breach any part of these Terms, we reserve the right to terminate the user account. We will not terminate an account unless there is a probable cause. A probable cause can be defined as, but not limited, to submitting untrue personal information, abusing the product reviews, or making fraudulent purchases. In the case of fraud, any possible information will be handed over to law enforcement for further investigation. Access to the account will be revoked at that time.
If you would like to delete your user account, please email us from your account’s associated email address and we will delete the account within 14 business days.

Disclaimer of Liability
This website is provided “as is” without any representations or warranties, express or implied. We expressly make no representations or warranties in relation to this website or the information and materials provided on this website.
Without prejudice to the generality of the foregoing paragraph, Balboa Mattress & More cannot warrant:

An exception to informational purposes is our financing application page. To apply for financing, we will refer you to the financing bank’s secure website to fill in your personal information. At that time, you are then under their own Terms and Conditions and Privacy Policy.

Item Information and Warranty
We only sell brand new items that come directly from a manufacturer itself or a distributor.
Item warranties are between the consumer and the manufacturer directly. Balboa Mattress & More may assist in contacting the manufacturer if any issue were to arise within the warranty period, but we are not a manufacturer that offers or provides any type of warranty. Each manufacturer has its own terms for coverage and voiding a warranty. We have no control of any warranty terms.

Warranties are only valid when you buy items from authorized retailers, like us. The “original purchaser” is considered to be you, the consumer, who purchased the item, unless the manufacturer specifies otherwise in their warranty terms. In most cases, limited warranties are non-transferable, so the person that buys the item keeps the warranty until the item is no longer good for service. Any possible claim, the manufacturer might request an original purchase invoice and/or other form of proof. Warranties do not apply to any item sold “as is”, “used”, “repurposed”, “previously owned”, or “demo” items. Warranties also do not apply if the items are used in a commercial/industrial setting or if the intent was to resell the item.

[Mattresses]
Most mattress we sell range between 5 and 20 years of limited warranty with the manufacturer. However, the warranty is voided with any of the following:

  • Physical abuse (liquid damage, cuts, tears, stains, burns)
  • Use of improper bed frame, foundation, or adjustable base
  • Floor or demo pieces sold at a discount
  • Any mattress sold “as-is”, “used”, or “previously owned”
  • Comfort preference
  • Mattresses sold by unauthorized retailers
  • Normal indentations

These warranty void possibilities are the most common, but the list is not limited to the previously mentioned. Each mattress will have the included warranty length next to its description. If you would like to read more about a manufacturer’s detailed warranty coverage, please email us with a request or you can search in their website for their Warranty information.

[Furniture]
Our furniture has a manufacturer limited warranty of thirty (30) days from the date of receipt against material defects and/or workmanship. Receipt means either you received the item(s) through delivery or picked up at the store. If any parts are missing, please inform us within 48 hours and we will try to resolve your problem as soon as possible.

Some examples of material defects include but not limited to the following: warping, misaligned screw holes, improper size cuts, peeling off finish, sagging, or anything that prevents the item from functioning properly. Cleaners, chemical treatments, stains, household humidity, physical abuse, misuse, cosmetic damage, improper operation, modification or alteration, and improper assembly are all examples, but not limited to, possibilities the warranty can be voided. Warranty is also voided if the furniture is used in any location other than a normal household. Any sign that the damage was inflicted due to an accident or from improper handling, the warranty will also be voided.

Any parts that were initially missing we can have delivered to you or you can pick up at the store. In the very rare case that a whole furniture needs to be sent back, please contact us for available options. We just want to make it right.
In some cases, we might ask for pictures to be sent to us so we can forward to the manufacturer. Please note that this is a standard protocol for some claims, though it’s not always a requirement.

Typographical Errors
Please note that our website may contain typographical errors or inaccuracies and may not be complete or current. We reserve the right to correct any errors, inaccuracies or omissions and to change or update information at any time, without prior notice (including after an order has been submitted). Such errors, inaccuracies or omissions may relate to product description, pricing, promotion and availability and we reserve the right to cancel or refuse any order placed based on incorrect pricing or availability information.

Mattress Warranty Protection
Most mattresses come with a manufacturer limited warranty between 5 and 20 years, depending on the brand and model. Most mattress limited warranties cover defects that affect the use of the product, such as squeaking, structure damage, or extreme sagging under normal wear. A solid foundation or a solid frame/base is expected to always be present supporting the mattress. However, most manufacturers DO NOT accept warranty claims with mattresses that have any damage on their fabric. For example, if you spill wine or urine and stain the mattress, that is considered physical damage on the item, so the warranty is voided. Even if the stain is the size of a dime. Cuts, tears, stains, bugs, pet dander, and burns are other considered types of damage that might also void a manufacturer’s warranty. As a result, we offer a mattress cover protector that can help retain the manufacturer’s warranty for the most common cases. From our experience, in average, the most common reason for a voided manufacturer warranty is because of stains. Our available optional mattress cover protector is 100% waterproof. The protector is intended to protect your mattress against body fluids, dust mites, pet dander, or other liquids that may stain the fabric. However, corrosive cleaners or some dangerous chemicals do not fall under the category of body fluids or liquids, since they might eat through the cover. The cool and breathable cotton is guaranteed by the manufacturer to protect your mattress up to 10 years. The mattress protector is machine washable so you have control of keeping your mattress clean at your leisure. We recommend to air dry the cover for longevity.

We have an available mattress cover protector for each mattress size, so please make sure you get the correct one for your mattress.
Balboa Mattress & More does not directly offer the protection or warranty for the mattress or protector. We only provide the available option for you to protect your mattress’ limited warranty in case there are any issues a few years after the date of purchase. Any single stain anywhere on the mattress can potentially void the warranty. Protect your investment and you will thank us later.
